These Terms of Service ("Terms") apply to your use of www.thegroceryrunners.com and tgrhelp.com (the "Sites") and to delivery services provided by Cherish Productions LLC, doing business as The Grocery Runners ("The Grocery Runners," "we," "us," or "our"). By using the Sites or receiving a delivery from us, you agree to these Terms.
1. Our Services
The Grocery Runners provides last-mile delivery of groceries and other retail goods on behalf of our retail partners, such as Roche Bros. Supermarkets. We pick up orders from the retailer and deliver them to the address provided at checkout.
2. Orders and Payment
Orders, prices, product selection, substitutions, payments, refunds, and tips are placed and processed through the retailer's own website or app, not through The Grocery Runners. Questions about your order contents, charges, or refunds should be directed to the retailer. The retailer's own terms and privacy policy also apply to your order.
3. Delivery
We make reasonable efforts to deliver within the time window selected at checkout, but delivery times are estimates and may be affected by weather, traffic, or other conditions outside our control. Please make sure your address, phone number, and delivery instructions are accurate.
If no one is available to receive an order and no leave-at-door instructions were given, our driver will wait a reasonable time and may return the order to the store. The retailer may then arrange a redelivery.
4. Alcohol Deliveries
Alcohol is delivered only to persons 21 years of age or older who present valid government-issued photo identification at the time of delivery. If no one at the delivery address can show valid ID, or if the recipient appears intoxicated, alcohol will not be delivered and will be returned to the store. The rest of the order will still be delivered.
5. Text Messaging Terms
Program: The Grocery Runners Delivery Updates.
Description: Text messages about the status of your grocery delivery, including driver-on-the-way and delivered notices, and a link to rate your delivery or tip your driver. No marketing messages are sent.
Cost: Message and data rates may apply.
Opt out: Reply STOP at any time. You will get one message confirming you are unsubscribed, and no further messages will be sent.

Carriers are not liable for delayed or undelivered messages.

6. Use of the Sites
You agree not to misuse the Sites, including by attempting to gain unauthorized access, interfering with their operation, or using them for any unlawful purpose. All content on the Sites, including our name and logo, belongs to The Grocery Runners and may not be used without our permission.
7. Disclaimers
The Sites and our services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied. Product quality, freshness, and accuracy of order contents are the responsibility of the retailer.
8. Limitation of Liability
To the fullest extent permitted by law, The Grocery Runners will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Sites or our services. Our total liability for any claim related to a delivery will not exceed the delivery fee paid for that order.
9. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date.
10. Governing Law
These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-law rules.
